Terms of Service

1. Acceptance of Terms
By creating an account, purchasing a subscription, or downloading and/or using the Phantom Dungeons software plugin (collectively, the "Service"), you ("Customer", "you") agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not accept these Terms in full, you must not use the Service.
These Terms govern the relationship between Phantom Development ("we", "us", "our") and you. We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 14 days' notice via the email address associated with your account. Continued use of the Service after the effective date constitutes acceptance.
2. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction (whichever is greater), to create an account and purchase a subscription. By using the Service, you represent and warrant that you meet this requirement.
The Service is intended for operators of Minecraft multiplayer servers. Use of the Service for any other purpose is outside the scope of the licence granted herein.
3. Software Licence Grant
3.1 Subscription Licence (JAR / Compiled Plugin)
Subject to these Terms and payment of the applicable subscription fees, Phantom Development grants you a limited, non-exclusive, non-transferable, revocable licence to:
- Install and run one (1) instance of the Phantom Dungeons compiled plugin JAR file on a single Minecraft server network that you own or operate.
- Configure the plugin using the provided YAML configuration files.
- Use the plugin's public API to develop integrations for your own server only.
"Single server network" means a collection of servers sharing the same Minecraft network (e.g. BungeeCord / Velocity proxy), operated under a single ownership entity. Running the plugin across separately branded or independently operated servers requires additional licences.
3.2 Source Code Licence
If you have separately purchased a Source Code licence, the specific terms of that licence (as communicated at the time of purchase) govern your use of the source code. Unless explicitly stated otherwise, source code licences are non-exclusive and permit modification for your own use; they do not grant a right to resell, sublicence, or publicly distribute modified versions of the source code.
3.3 Restrictions
You must NOT:
- Share, sell, sublicence, rent, lease, or otherwise distribute the plugin JAR or any derived product to third parties without our express written consent.
- Share your licence key with any third party.
- Reverse engineer, decompile, or disassemble the compiled plugin JAR, except to the extent permitted by applicable law.
- Circumvent, disable, or interfere with any licence validation, IP checking, or authentication mechanism.
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Represent to any third party that you created the Software or that you have ownership rights beyond the licence granted herein.
4. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials. You must not share your login details with any third party. You are responsible for all activity that occurs under your account.
You agree to notify us immediately at support@phantomdungeon.com if you become aware of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, or that are being used in violation of these Terms.
5. Subscription, Billing & Payment
5.1 Subscription Plans
We offer subscription-based access to the Service billed on a recurring monthly basis. All prices are displayed in US dollars (USD) and exclude any applicable taxes unless stated otherwise.
5.2 Founders Pricing
Customers who subscribe during the Founders period are entitled to a locked monthly rate ("Founders Rate") for as long as their subscription remains continuously active. The Founders Rate is a personal, non-transferable benefit tied to the original subscription. The Founders Rate is forfeited if:
- Your subscription is cancelled for any reason (including non-payment); or
- You request a plan downgrade or change that terminates the existing subscription.
Re-subscribing after forfeiture will apply the then-current standard pricing. We reserve the right to close Founders pricing to new subscribers at any time without notice.
5.3 Billing & Renewal
Subscriptions renew automatically at the end of each billing period unless cancelled. Payment is processed by Stripe. By providing a payment method, you authorise Stripe to charge the applicable fees on a recurring basis.
If a payment fails, your account will enter a grace period. We will attempt to retry the charge. If payment cannot be collected within 7 days, access to the Service (including the ability to download the plugin and license validation) may be suspended until payment is received.
5.4 Taxes
You are responsible for all taxes, levies, and duties imposed by your taxing authority arising out of your use of the Service. We will collect VAT/GST where required by law.
5.5 Refund Policy
We offer a 7-day refund window from the date of your initial purchase if:
- You have not substantially used the Service (i.e. you have not deployed the plugin on a live server with active players); and
- You request the refund via support@phantomdungeon.com within 7 calendar days of your purchase date.
Refunds are not available after the 7-day window, or for any subsequent renewal charges. Source code purchases are non-refundable once the source code has been accessed or downloaded. We reserve the right to decline refund requests that we determine to be abusive (e.g. repeated purchase-refund cycles).
6. Licence Keys & Server Validation
Upon an active subscription, you will be issued a unique licence key. This key must be placed in your server'sconfig.yml and is validated against our licensing API on plugin startup. The API records your server's IP address for the purpose of this validation.
A maximum number of authorised IP addresses are permitted per licence (configurable by us per plan). If you need to change your server IP, you may request an IP reset via the dashboard. We reserve the right to limit the frequency of IP resets to prevent abuse.
Licence keys are personal and non-transferable. Any attempt to share or sell a licence key constitutes a material breach of these Terms and will result in immediate licence revocation without refund.
7. Updates & Downloads
Active subscribers are entitled to download the latest compiled JAR from the Downloads section of the dashboard. We will endeavour to provide updates on a reasonable basis but do not guarantee any specific release cadence.
We reserve the right to discontinue updates or features at any time. Discontinuation of a feature does not entitle you to a refund unless the core functionality of the plugin is materially impaired.
8. Acceptable Use
You agree not to use the Service to:
- Operate servers that violate Mojang's Minecraft Usage Guidelines.
- Engage in any activity that constitutes cheating, fraud, or deception towards your players in a manner that could expose Phantom Development to legal liability.
- Use the Service in connection with any unlawful gambling, illegal financial schemes, or prohibited content.
- Attempt to gain unauthorised access to our systems, databases, admin panel, or other customers' data.
- Use the Service in any manner that could damage, disable, or impair our infrastructure or disrupt other customers' use of the Service.
9. Intellectual Property
The Phantom Dungeons software, source code, documentation, branding, and all associated intellectual property rights are and remain the exclusive property of Phantom Development. These Terms do not transfer any ownership rights to you. Your licence under §3 is the only right granted.
You retain ownership of any custom configuration files, YAML definitions, and content you create using the Service (your "Configuration Content"). By using the Service, you grant us a limited licence to process your Configuration Content solely to the extent necessary to provide the Service.
10. Termination & Suspension
10.1 By You
You may cancel your subscription at any time via the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period. You remain responsible for all charges incurred prior to cancellation. Upon cancellation your licence will be revoked and access to downloads will be suspended.
10.2 By Us
We may suspend or terminate your account and licence immediately and without notice if:
- You materially breach these Terms (including but not limited to licence key sharing, circumvention of licensing validation, or non-payment);
- We are required to do so by law or court order;
- We reasonably determine that your use of the Service creates a legal or security risk to us or other users.
Where termination is at our discretion for reasons other than your breach, we will provide 30 days' written notice and a pro-rata refund of any prepaid subscription fees.
10.3 Effect of Termination
Upon termination, your licence immediately ceases. You must uninstall the plugin from all servers. Sections 3.3, 9, 11, 12, 13, and 14 survive termination.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service is compatible with any specific version of Minecraft or third-party server software. Minecraft and its server software are third-party products not under our control.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHANTOM DEVELOPMENT AND ITS OPERATORS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR SERVER DOWNTIME, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) £100 GBP.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Phantom Development and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms;
- Your violation of any applicable law or third-party rights;
- Content or configuration deployed on your server using the Service.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for resolution of any disputes arising out of or in connection with these Terms.
For consumers in the European Union, you may also benefit from any mandatory consumer protection provisions of the law of the EU member state in which you reside.
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting support@phantomdungeon.com and allowing 30 days for good-faith resolution.
15. General Provisions
- Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Phantom Development relating to the Service and supersede all prior agreements.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver. Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
- Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force Majeure. Neither party shall be liable for delays or failures in performance caused by events beyond their reasonable control, including but not limited to natural disasters, service outages of third-party providers, or government actions.
